The Bombay High Court today, September 23, raised concerns and expressed anguish over the fact that in several serious offences, the accused are being released on a technical ground. “God forbid us if we go by the technicalities,” the high court stated while observing that the accused are released on technical grounds that the investigating officer did not give them the “grounds of arrest” in writing. The high court bench of Justices Bharati Dangre and Manjusha Deshpande observed while hearing a plea filed by Mihir Shah, the prime accused in the Worli hit-and-run case. Shah challenged his arrest, stating that the same was illegal since the investigating officer did not give him the “grounds of arrest” in writing.
