The Kerala High Court has recently held that a woman’s live-in partner cannot be prosecuted under Section 498A of the Indian Penal Code for cruelty. According to Live Law, Justice A Badharudeen also said the Section 498A applies only to legally wedded spouses, adding husband means married man. The ruling comes from a case where the petitioner had asked the High Court to stop the criminal proceedings filed against him by his former live-in partner. She alleges that he had mentally and physically harassed her from March 2023 to August 2023 during their relationship.
