NEW DELHI: The Supreme Court in a majority judgment on Monday upheld the validity of the Constitution’s 103rd Amendment Act 2019, which provides for 10 per cent to economically weaker sections (EWS) reservation in admissions and government jobs.
A five-judge Constitution bench in a 3:2 majority verdict has held that the provisions of the amendment does not violate essential features of the Constitution.
Chief Justice of India UU Lalit and S Ravindra Bhat dissented from the majority verdict and struck down the 103rd Amendment Act.
The top court heard as many as 40 petitions and most of the pleas, including the lead one filed by ‘Janhit Abhiyan’ in 2019, challenged the validity of the Constitution Amendment (103rd) Act 2019.
Below is the chronology of events in which the apex Court delivered the judgment
January 8, 2019: Lok Sabha clears the 103rd Constitution amendment Bill.
January 9: Rajya Sabha clears the 103rd Constitution amendment Bill.
January 12: Ministry of Law and Justice issues notice, saying President Ram Nath Kovind has given assent.
February: New law challenged before Supreme Court.
February 6: Supreme Court issues notice to govt on pleas challenging amendment.
February 8: Supreme Court declines to stay 10% EWS quota.
September 8, 2022: Supreme Court bench headed by CJI U U Lalit constitutes five-bench to hear appeals.
September 13: Supreme Court starts hearing arguments.
September 27: The Supreme Court had reserved its verdict after hearing the case for over seven days.
November 7: SC, by majority of 3:2, upholds validity of 103rd Constitution amendment providing 10% reservation to EWS in admissions, govt jobs.
