Rahul Gandhi: Rahul Gandhi asked to appear before Patna court on April 25 in a defamation case | India News

PATNA: A court in Patna district on Wednesday asked Congress leader Rahul Gandhi to appear before it on April 25 in a defamation suit filed over his purported remark on Modi surname.
The defamation case was filed by BJPтАЩs Rajya Sabha member and former deputy chief minister Sushil Kumar Modi.
Earlier on March 18, the court of the Special Judge Aadi Dev had asked Gandhi to appear before it on April 12 (today). But Gandhi didnтАЩt turn up before the court on Wednesday and his counsel, during hearing of the case, sought another date on the plea that the entire legal team was busy with the Surat case, in which Gandhi was recently sentenced to two years in prison, and consequently, disqualified from the Lok Sabha.
Accepting the argument, the judge asked GandhiтАЩs counsel to ensure his (GandhiтАЩs) physical appearance before the court on the next date of hearing in the case on April 25.
Prosecution lawyer Priya Gupta told media persons outside the courtroom that statements from the complainant’s side have been recorded and all evidence has already been submitted to the court. Now only the statement of Gandhi is to be recorded under Section 313 CrPC.
Earlier, Sushil ModiтАЩs counsel SD Sanjay opposed Gandhi’s counselтАЩs time petition and urged the court to cancel bail of Gandhi and issue a warrant of arrest against the Congress leader to ensure his physical presence in the court.
Sushil Modi filed the defamation case in April 2019, accusing Gandhi of defaming the Modi community at a rally in KarnatakaтАЩs Kolar in the runup to the 2019 Lok Sabha elections. тАЬHow come all the thieves have Modi as the common surname?тАЭ Gandhi was quoted to have said in the rally.
The court has already recorded statements of complainant Sushil Modi, former road construction minister-cum-Bankipur BJP MLA Nitin Navin, Digha BJP MLA Sanjiv Chaurasia and the Bharatiya Janata Yuva Morcha leader Manish Kumar as witnesses from the prosecution side.
