The Madhya Pradesh High Court recently upheld the conviction of a juvenile for the rape of a four-year-old girl. During the case hearing, the High Court bench of Subodh Abhyankar lamented the “lenient” laws in the country so far as juvenile offenders are concerned. “Court is once again at pains to observe that juveniles in this country are being treated rather too leniently, and that the Legislature,to the utter misfortune of the victims of such crimes, has still not learnt any lessons from the horrors of Nirbhaya,” Justice Subodh Abhyankar said. The high court remarked while noting that the appellant, along with seven other juveniles, had absconded on November 13, 2019, and remained untraceable. As per a report in Live Law, the appellant was convicted by Sessions Court under various sections of the Indian Penal Code (IPC) and the POCSO Act, 2012. The sessions court had sentenced the appellant to ten years of rigorous imprisonment. HC on Child Marriage: Marriage of Minor Girl With Major Male May Cause Physical and Mental Cruelty, Can Be Used As Grounds for Divorce, Says Madhya Pradesh High Court.
