Madhya Pradesh High Court Says Special Marriage Act Union Between Hindu Girl and Muslim Boy Not Valid Under Muslim Law, Refuses Police Protection to Couple

The Madhya Pradesh High Court recently said that a marriage between a Muslim boy and a Hindu girl is not a valid marriage according to Mahomedan Law. The high court observed while turning down a plea for police protection to register an inter-faith marriage under the Special Marriage Act, 1954. The high court bench of Justice Gurpal Singh Ahluwalia also stated that a marriage between a Muslim boy and a Hindu girl would be treated as an irregular (or fasid) marriage under Muslim personal law even if they married under the Special Marriage Act. Madhya Pradesh High Court Laments Exploitation of Women Who Remarry Without Divorcing, Says ‘Unfortunate That Women Are Routinely Exploited in This Manner’.
