The Bombay High Court recently ordered the Thane Municipal Corporation (TMC) to demolish portions of the city’s Korum Mall. It is alleged that a few parts of the Korum Mall in Thane are illegal and allegedly built on nulah. “The Municipal Corporations and their Commissioners do have substantial powers under the Maharashtra Municipal Corporation (MMC) Act, 1949; however, these powers can never be exercised to benefit builders or developers at the cost of public amenities,” the court said. The high court imposed a cost of INR 2 lakh on a developer and the civic body. The high court bench of Justice Mahesh Sonak and Justice Kamal Khata also quashed the 2005 decision of the BMC Commissioner to regularise the construction of the famous Korum Mall in Thane on the site of a drain.
