Husband’s Suicide Over Wife’s Illicit Relationship Not Grounds for Abetment Conviction, Says Karnataka High Court; Acquits Woman and Partner
The Karnataka High Court recently overturned a trial court’s conviction of Prema and Basavalinge Gowda, accused of abetting Prema’s husband’s suicide. Justice Shivashankar Amarannavar ruled that while Prema’s husband may have been disturbed by her relationship with the co-accused, this alone did not establish legal grounds for abetment under Section 306 of the Indian Penal Code. The court observed that the couple’s statement, “go die,” lacked intentional instigation to drive the victim to suicide, especially without evidence of further coercive actions. The judgment emphasized that mere hurtful words without intent do not meet the threshold for abetment. Advocates AN Radha Krishna and B Lakshman represented the defense and the state, respectively.
