HC on ‘Spying’: Recording Conversation in Police Station Not Offence Under Official Secrets Act, Says Bombay High Court While Quashing Charges of Spying Against Two Brothers

The Bombay High Court’s Aurangabad bench recently said that recording conversations within a police station does not constitute an offence under the Official Secrets Act. The high court observed while quashing charges of spying against two brothers from Pathardi in Maharashtra. However, the high court declined to quash charges of criminal conspiracy against them under the Indian Penal Code (IPC). A high court bench of Justice Vibha Kankanwadi and Justice S G Chapalgaonkar also stated that the relevant facts from the First Information Report (FIR) and witness statements indicated that the entire incident occurred in a police station.
