A Central Coast man is on trial in Newcastle charged with sexually assaulting a woman he met on a dating app.
Justin Kane Millington, 49, is accused of raping the woman five times near a popular walking track in Lake Macquarie in the New South Wales Hunter region.
Millington has pleaded not guilty.
In district court on Wednesday, the jury heard the pair had been chatting via the dating app for some time before they met up for a walk on the Fernleigh Track at Belmont on October 7, 2020.
Notes taken by Doctor Shalu Singh, who examined the alleged victim at John Hunter Hospital later that evening, were read out by the prosecution:
It stated Millington “asked if he could hug her. She said ‘okay’…”.
“He started pulling her top off when she said ‘no’… He undressed completely… She froze and just did as he said… She was afraid.”
The jury also heard Singh was told the pair had been walking along the track moments earlier and went through some bushes, before Millington allegedly told the woman, “I’m going to take advantage of you” then raped her.
Singh told the court she noted bruising near one of the woman’s knees, but could not confirm when they occurred.
