HC on Rape Case: Kerala High Court Denies Anticipatory Bail to Mother Who Facilitated Rape of Her Minor Daughter by Stepfather, Says ‘An Insult to Motherhood if Proved To Be True’

The Kerala High Court recently, while denying anticipatory bail to a mother who allegedly facilitated the rape of her minor daughter by the stepfather, said that the incident was an “Insult to Motherhood”. The High Court bench of Justice P Gopinath also stated that the allegation against the petitioner-mother appeared to be serious, and it was an insult to motherhood if proved to be true, reports Bar and Bench. Justice Gopinath also took note of the apprehension raised by the Public Prosecutor, who said that there is a possibility of the minor survivor being influenced or intimidated if the petitioner is granted bail. “I am of the view that the petitioner is clearly not entitled to anticipatory bail. The allegations against the petitioner are very serious and if true they are an insult to motherhood,” the High Court observed. Kerala High Court Rules Government Cannot Disqualify Person From Service if Criminal Case Registered.
